Privacy Policy
  • This Terms of Use ("Agreement") is an essential part of the binding agreement between Leaksy ("we," "us," or "our") and each individual end user ("you" or "your") regarding the download, installation, and use of the Leaksy app and its related services (the "Service" or "Services"). Your downloading, installation, use, and access to the software are subject to your acceptance and compliance with the terms outlined in this Agreement. We reserve the right to modify the terms of this Agreement concerning updates to the Leaksy app. You can review the updated version of this Agreement within the app. By continuing to use the Leaksy app after the effective date of the modified terms, you signify your acceptance and compliance with the updated terms.

    Restrictions on Use:
    1.1 By complying with this Agreement, we grant you permission to access and utilize the Service under the following explicit conditions. Failure to adhere to any of these conditions constitutes a breach of this Agreement on your part:
    1.1.1 You agree not to distribute any part or elements of the Leaksy app or the Service in any medium without obtaining our prior written authorization, ensuring compliance with this Agreement.
    1.1.2 You agree not to alter or modify any part of the Service.
    1.1.3 You agree not to use the Service for any commercial purposes, including but not limited to the sale of access to the Service or the sale of advertising, sponsorships, or promotions within the Service. Prohibited commercial uses do not include (i) the usage of your edited photographs or images owned by you using the Service. Please note that you may not commercially use the stock photos provided by the Service, and you hereby agree to indemnify Leaksy for any damages resulting from such commercial usage of the stock photos; (ii) any use expressly authorized by us in writing.
    1.1.4 You agree not to use or initiate any automated system, including robots, spiders, or offline readers, that access the Service in a manner that generates more request messages to the Service within a given period than a human can reasonably produce using a publicly available standard web browser that is unmodified.
    1.1.5 You agree not to collect or harvest any personal data of Service users.
    1.1.6 You agree not to use the Service for soliciting business in the course of trade or in connection with a commercial enterprise.
    1.2 You agree to comply with all other provisions of this Agreement during your use of the Leaksy app and the Service.
    1.3 You acknowledge that you are solely responsible for any breach of your obligations under this Agreement and the resulting consequences, including any loss or damage suffered by us or any third party.

    Intellectual Property Policy:
    2.1 The Leaksy app is independently developed by us. You acknowledge and agree that we retain all copyrights, trademarks, patents, business secrets, and other intellectual property rights related to the software. The Leaksy app and its related information, including but not limited to written expression, icons, decorative pictures, tables, colors, user interface, framework, related data, printing materials, or electronic documents, are protected by copyright, trademark, patent, anti-unfair competition laws of the People's Republic of China (PRC), relevant international agreements, and other intellectual property laws and regulations.
    2.2 Unauthorized copying, distribution, modification, public display, or public performance of copyrighted works is considered copyright infringement, and we reserve the right to take appropriate action against copyright infringers.
    2.3 Your use of the Service is conditioned upon your agreement not to use it in any way that infringes upon the intellectual property rights of others. We may terminate engagement with any user suspected of infringing the copyrights or other intellectual property rights of others or take other actions against such users at our sole discretion. Furthermore, in appropriate circumstances and in accordance with applicable laws, we may remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and remove or disable access to any reference or link to infringing material or activity.

    Paid Services:
    3.1 Subscriptions:
    - Subscriptions provide ongoing access to dynamic content or services within the Leaksy app. Different fees may apply for specific periods ("Subscription Period"), as specified in the app. Payment will be charged to your iTunes account upon confirmation of the subscription through the available confirmation tools.
    3.2 Trial:
    - Trial subscriptions are offered free of charge for a specified period from activation, as indicated in the relevant offer within the app. If you do not cancel the subscription within the trial period, the subscription fee will be charged to your account upon the trial period's expiration. Please note that your subscription begins immediately after activating the trial, not after the 3-day trial period. You can cancel a subscription during its free trial period using the subscription settings of your account. We cannot cancel your activated free trial subscription.
    3.3 Auto-renew:
    - Subscriptions are automatically renewable unless you turn off the auto-renewal feature at least 24 hours before the current subscription expires. The subscription fee will be charged to your iTunes account within 24 hours prior to the current subscription's expiration. If the subscription fee cannot be charged due to insufficient funds, an invalid credit card, or any other reasons, your subscription will be automatically canceled.
    3.4 Canceling Subscriptions:
    - After purchasing a subscription, you can manage it and disable automatic renewal at any time through your iTunes account settings. You cannot cancel your current subscription if it has already been activated. If you properly terminate your paid subscription, you will not be charged for future months or periods as stated in the subscription terms. However, no refund will be provided for any unused portion of a month or period for which you have already paid.
    3.5 We reserve the right to change the fees. If there are changes to the fees, we will provide notice of the change within the Leaksy app. Your continued use of the app after the fee change becomes effective signifies your agreement to pay the updated amount.

    YOU ACKNOWLEDGE THAT IF YOU CHOOSE TO PURCHASE A SUBSCRIPTION, YOUR SUBSCRIPTION IS SUBJECT TO AUTOMATIC RENEWALS. YOU HEREBY CONSENT TO AND ACCEPT RESPONSIBILITY FOR ALL RECURRING CHARGES TO YOUR APPLICABLE PAYMENT METHOD BASED ON THIS AUTOMATIC RENEWAL FEATURE WITHOUT FURTHER AUTHORIZATION FROM YOU AND WITHOUT FURTHER NOTICE EXCEPT AS REQUIRED BY LAW. YOU FURTHER ACKNOWLEDGE THAT THE RECURRING CHARGE AMOUNT MAY CHANGE IF APPLICABLE TAX RATES CHANGE OR IF THE FEES (INCLUDING OUR FEES AND CREDIT CARD HANDLING FEES) HAVE INCREASED.

    Content:
    4.1 As a user of the Leaksy app, you may submit graphics, photos, videos, and other materials ("Content"). You understand that we do not guarantee any confidentiality regarding your Content, whether published or not. We cannot guarantee your ability to retrieve or save posted Content locally, and we are not responsible for any loss of Content.
    Content:
    4.2 You maintain full ownership rights to the content you create, but you are required to grant us and other users of the Service a limited license to access and use your content.
    4.3 You acknowledge that you are solely responsible for your content and the consequences of posting or publishing it. We do not endorse any content or any opinions, recommendations, or advice expressed therein, and we disclaim any liability associated with content.
    4.4 You represent and warrant that you have all the necessary licenses, rights, consents, and permissions required for us to use your content for the provision of the Service. You also warrant that your content does not violate any third-party rights and complies with the laws, rules, and regulations of competent jurisdictions. You agree to defend, indemnify, and hold us harmless from any claims arising from your breach of these representations and warranties.
    4.5 You agree to comply with this Agreement and ensure that your content complies with its provisions. You warrant that you own or have the rights to your content, that there are no restrictions preventing you from granting the licenses herein, and that your content does not facilitate illegal activity, contain defamatory or discriminatory content, infringe upon third-party rights, or violate any laws or regulations. You further agree to indemnify us and our directors, employees, shareholders, customers, agents, successors, and assigns against any claims arising from your content.
    4.6 You agree not to post or upload any content that is unlawful for you to possess or for us to use in connection with the Service, based on your country of residence.
    4.7 You agree that your content submitted to the Service does not contain any third-party copyright material or other proprietary rights, unless you have the proper license or permission from the rightful owner.
    4.8 We reserve the right, at our sole discretion, to determine whether content complies with the requirements outlined in this Agreement. We may remove such content and terminate a user's access if they upload content that violates this Agreement, without prior notice.

    Privacy Policy:
    5.1 Your use of the Leaksy app is subject to our Privacy Policy, which is incorporated by reference. We value your privacy and have designed our Privacy Policy to provide important information about how we collect and use your information. We encourage you to carefully review the policy to make informed decisions.
    5.2 The Leaksy app may request permissions to access your device's camera and photo album during regular operation, as well as to receive notifications. If additional permissions are required, we will request them in advance.

    Indemnification:
    You agree to hold us harmless from any claims, including damages, asserted by other users, third parties, or public agencies, arising from your violation of this Agreement and our Privacy Policy. You are responsible for any reasonable costs, including legal defense costs, incurred by us due to your violation of other users' or third parties' rights. Our rights and claims for damages remain unaffected.

    Limitations of Liability and Disclaimer:
    7.1 You acknowledge and agree that the Software and Services may entail potential risks, such as service interruptions, unresponsiveness to user requests, and other factors beyond our control, including force majeure events, mobile communication issues, system instability, physical location, and device-related problems. We shall not be liable for any such risks.
    7.2 We are not liable for any losses incurred by users due to telecommunication line breakdowns, technical problems, internet issues, mobile communication failures, system instability, or force majeure events.
    7.3 We reserve the right to amend or terminate the Services without prior notice, and we shall not be liable to users or any third parties in exercising this right.
    7.4 Unauthorized software versions and derivative works are illegal. Downloading, installing, and using such software may pose unexpected risks for which we are not liable.
    7.5 We reserve additional disclaimer rights as permitted by applicable law.
    7.6 We assume no liability for any loss or damage resulting from the use, editing, adaptation, or modification of user-maintained photos or images. We are also not responsible for any consequences of sharing photo information with third-party websites or resources accessed through the Software.

    Termination:
    8.1 You have the right to uninstall the Leaksy app from your device at any time, thereby terminating this Agreement.
    8.2 Unless either party unilaterally terminates this Agreement, it will remain effective.
    8.3 Your rights will be automatically terminated if you breach any obligations stated in this Agreement. Additional notice is not required from us or any third parties.
    8.4 Termination of this Agreement does not affect any obligations or liabilities that users have prior to termination.

    Amendment:
    We reserve the right to amend this Agreement based on changes in laws, regulations, and operational needs. Such amendments will be notified or published within the Leaksy app. Your continued use of the app will be considered acceptance of the updates.

    Other:
    10.1 Our failure to exercise or enforce any legal right or regulation does not constitute a waiver of our rights, and we retain the right to exercise or enforce such rights or regulations at any time.
    10.2 Without written authorization, you may not assign or transfer the rights granted by this Agreement or delegate the designated responsibilities and obligations to others.
    10.3 If any provision of this Agreement is deemed invalid by a court of law, that provision will be removed without affecting the remaining terms, which will continue to be valid and enforceable.
    10.4 We have the final interpretation rights regarding this Agreement.
